Overview: The agent is the first link in the chain between a prospective insured and the insurance company, and the agent's conduct shapes the integrity of everything that follows.

An insurance agent occupying this position operates in two directions at once. Legally, the agent represents the insurance company — the agent acts on behalf of the insurer and within the scope of authority granted by the agency contract. Ethically, the agent also owes a duty of fair dealing to the applicant: explaining the product accurately, recommending coverage suitable to the applicant's needs, and avoiding deception or manipulation.

On the insurer's side, the agent's most important underwriting function is field underwriting — serving as the company's eyes and ears during the solicitation. This means asking every question on the application carefully, recording answers truthfully, and reporting anything the agent observes that bears on the applicant's insurability. If an agent notices oxygen tanks or medical equipment in a client's home and omits that from the submission, the agent has contributed to insurance fraud. Insurers rely on agents to bring in accurately represented business; knowingly submitting a misleading application exposes both the agent and the insurer to legal liability.

On the applicant's side, the agent must fully disclose the policy's features, premiums, exclusions, and limitations. Several practices are prohibited by state law because they harm applicants:

Twisting: Convincing a policyholder to replace an existing policy using misleading comparisons or misrepresentations about the new policy.
Churning: Replacing policies within the same company primarily to generate new commissions, with no benefit to the client.
Rebating: Offering a prospect any part of the agent's commission or other inducement not specified in the policy. Illegal in nearly all states.
Sliding: Adding fees or riders to a policy without the applicant's knowledge or consent.

Premium money collected at point of sale must be handled as trust funds — held separately and remitted promptly to the insurer. Commingling client premiums with personal funds is both an ethical violation and a legal one in most states.

When agents fail in these duties — by misrepresenting coverage, failing to secure requested coverage, or making unauthorized promises — they face professional malpractice exposure under errors and omissions (E&O) liability. Because the agent acts on behalf of the insurer, the agent's negligence can also be attributed back to the company.
